The agreement

Terms of service

Effective October 15, 2026 (Early Access terms).

These terms are an agreement between you and SimuSign LLC, an Illinois limited liability company ("SimuSign", "we", "us"), about your use of the SimuSign website, studio, trainer and related services (the "Service"). By creating an account, subscribing, or using the Service, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the Service.

Please read section 14 carefully. It requires most disputes between you and us to be resolved by individual arbitration rather than in court, and it gives up class actions. You can opt out of it within 30 days, as section 14 explains.

SimuSign is in Early Access. It is not a replacement for a live interpreter and is not intended for medical, legal, emergency or other high-stakes communication at this time.

1. Early Access

SimuSign is in Early Access: an early release of a service that is still being built. The "Early Access Period" lasts until we announce the general release of SimuSign version 1 ("v1") on the Service.

During the Early Access Period the Service is provided "as is" and "as available". Features may change, be limited, or be withdrawn, and the Service may be interrupted, unavailable at times, or end. We make no commitment about uptime or availability.

Output may contain errors. The signer can mis-sign a word, sign words in an order a fluent signer would not use, fingerspell a word that has a sign, or leave words out, and captions can mis-hear speech. Live signing can fall behind the speech, further during fast or long speech. We do not promise that any signing, caption or other output is correct, complete or on time. Do not rely on the output for any of the uses described in section 2.

What the Service does today, and its known limits, are described on our limits page. We update that page as the Service changes.

If you send us feedback, ratings or suggestions, you give us a perpetual, worldwide, royalty-free licence to use them to improve SimuSign, with no obligation to you. Feedback may earn live-minute credit at our discretion.

2. What SimuSign is, and what it is not

SimuSign is an English-to-ASL translation system in development. It shows English text and speech as American Sign Language on a 3D signing avatar.

SimuSign is in Early Access. It is not a replacement for a live interpreter and is not intended for medical, legal, emergency or other high-stakes communication at this time.

Do not use the Service for medical, legal, emergency or safety-critical communication; for financial decisions; for high-stakes employment matters such as interviews, performance reviews, discipline or workplace accommodation; in any situation where the law requires a qualified interpreter; or for any other communication where a mistake could cause harm. Do not present the Service's output to anyone as professional interpretation.

SimuSign is not a qualified interpreter, and it is not offered as an auxiliary aid or service or as a reasonable accommodation. If you are a business, school, employer, healthcare provider, government body or other organization with a legal duty to communicate effectively with Deaf or hard-of-hearing people — for example under the Americans with Disabilities Act or Section 504 of the Rehabilitation Act — using SimuSign does not meet that duty, and you remain responsible for providing the interpreter or other aid the law requires.

3. Accounts and eligibility

You must be at least 18 years old, or the age of majority where you live if that is higher, to create an account or buy a plan. SimuSign is not directed to children under 13; do not send us personal information from a child under 13.

One account per person. Give us true and current information, keep your password to yourself, and do not share your account. We may ask you to confirm your email address before some features — such as free live minutes — are available.

You are responsible for activity under your account. Tell us promptly at [email protected] or through if you think your account has been misused.

The Service is offered to people in the United States and Canada. It is not offered to residents of Quebec at this time. If you use it from somewhere else, you do so on your own initiative and you are responsible for following the laws that apply where you are.

4. Electronic communications

You agree that we may give you notices, disclosures, receipts, renewal and price-change notices and other communications about the Service electronically — by email to the address on your account or on the Service — and that they satisfy any legal requirement that they be in writing. Keep your email address current. You can ask us for a paper copy of any of them at [email protected]; asking does not end your consent. You can withdraw this consent by closing your account.

5. Acceptable use

You agree not to:

  • record, capture, scrape or otherwise extract the avatar's signing or animations by automated means, or use them to build a dataset or train a model;
  • copy, redistribute, sell or publish the animations, signs or other content of the Service outside the Service;
  • use the Service for anything unlawful or harmful, or submit content that is unlawful or infringes anyone's rights;
  • stream or upload other people's speech without the permission the law requires — before you stream a conversation, make sure the people speaking have agreed to it, and do not stream confidential conversations without the permission they require;
  • get around usage limits, meters or verification — for example by opening several accounts to obtain more free minutes;
  • interfere with, probe or overload the Service, or reverse engineer it except where the law allows;
  • use the Service in violation of United States export-control or sanctions laws.

We may suspend or close accounts that break these rules.

6. Plans and billing

Free plan. The Free plan includes the live-translation allowance shown on our pricing page once you confirm your email address, and text translation subject to fair-use limits. Free access does not charge you or turn into a paid subscription; subscribing to Early Access is a separate purchase.

Early Access plan. The Early Access plan is a paid monthly subscription. Its price, its monthly allowance of live minutes, any tax we collect, and the total you will pay are shown before you subscribe. We do not add mandatory service or processing fees. Payments are processed by Stripe.

Automatic renewal. Your subscription renews automatically one month at a time until you cancel. Before you subscribe, we ask you to tick a box agreeing to the automatic renewal. By subscribing, you authorize us to charge the monthly price, plus any tax we collect, to your payment method at each renewal until you cancel. After you subscribe, we email you a confirmation with the price, the renewal terms and how to cancel.

Cancelling. You can cancel renewal online at any time from your account page — you do not need to call us, speak with a person, answer a survey or hear an offer, and there is no cancellation fee. Cancellation takes effect at the end of the billing period you have paid for: your account shows that date, you keep your plan until then, and you will not be charged again.

The Early Access price. The Early Access price is held for 12 months after v1's general release while the subscription stays active. The hold covers the base subscription price — not taxes, optional top-ups, or a different plan you choose — and no price change overrides it. We will show the date your hold ends in your account when v1 is released. If the subscription ends, the held price ends with it.

Top-ups. You may be able to buy extra live minutes as a separate one-time purchase. Top-ups are prepaid and are never bought automatically. Before you buy, we show the minutes included, the total price, and the expiry and refund terms; top-ups are valid for 12 months from purchase unless the law where you live requires longer.

Taxes. If we collect sales or similar tax on a purchase, it is shown at checkout before you pay.

Price changes. We may change prices for new subscriptions at any time. For an existing subscription, we will email you before a new price applies, within the notice period the law where you live requires, and we will not charge you a higher price unless you accept it. You can cancel renewal before any change takes effect.

Refunds. We do not refund partial billing periods. If you ask within 7 days of your first charge, we will refund that first charge. If a failure of the Service keeps you from using live minutes you paid for, we will credit those minutes to your account. If we end a paid subscription for a reason other than your breach of these terms, we will refund the unused part of the current billing period. To ask for a refund, email [email protected]. These refund terms do not limit any refund or remedy the law where you live gives you.

Premium and Enterprise. Premium and Enterprise plans are coming with v1. They are not on sale during Early Access, and nothing in these terms promises their features, price or timing. Roadmap items are plans, not promises; timing and scope may change. This does not change the paid access and billing terms you agreed to. Enterprise terms and pricing will be provided in a separate written agreement before any purchase.

7. Live minutes and limits

Live translation — from your microphone or a browser tab — uses live minutes. Minutes count while listening is on, whether or not anyone is speaking. Text translation does not use live minutes.

Once limits are on, your account shows how many live minutes you have left and when they renew.

When your minutes run out during a session, the signer finishes the sentence it is on and then stops listening. Text translation keeps working.

We may set fair-use limits — for example on requests per minute or sessions open at once — to keep the Service available for everyone.

8. Your content, and ours

You keep whatever rights you have in the text and audio you submit, and you give us permission to process it to provide the Service. How we collect and use information is described in our Privacy Policy.

The Service — including the avatar, its animations and signs, the software and the site — belongs to SimuSign and its licensors. We give you a personal, non-transferable, revocable right to use it under these terms.

9. Disclaimers

To the fullest extent the law allows, the Service and all of its output are provided "AS IS" and "AS AVAILABLE", with all faults. We disclaim all implied warranties, including any warranty of merchantability, fitness for a particular purpose, title or non-infringement, and any warranty arising from a course of dealing or usage. We do not promise that the Service or its output will be correct, complete, timely, error-free, uninterrupted, secure or available, or that it will meet your needs. Nothing in these terms excludes rights you have under consumer-protection laws that cannot be waived, or our express billing and Early Access price commitments in section 6.

10. Limitation of liability

To the fullest extent the law allows:

  • we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, even if we were told they were possible;
  • we are not liable for any loss that arises from using the Service for a use described in section 2;
  • our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the event that gave rise to the claim, or (b) US$50.

These limits do not apply to liability that the law does not allow us to limit, such as liability for fraud, or for death or personal injury caused by our negligence where the law forbids the limit. Some places do not allow some of these limits; where that is so, they apply to the extent the law allows.

11. Indemnity

If you use the Service in breach of these terms or the law — including for a use described in section 2, or by streaming other people's speech without the permission the law requires — and someone brings a claim against us because of it, you agree to cover our reasonable losses and costs from that claim, to the extent the law where you live allows.

12. Suspension and ending

You can stop using the Service at any time, and you can delete your account yourself from your account page or ask us at [email protected]. We may suspend or end your access if you break these terms, if the law requires it, or if we stop offering the Service. If we end a paid subscription for a reason other than your breach, we will refund the unused part of the current billing period.

13. Changes to these terms

We may update these terms. We will post the new version here with its effective date. For a material change, we will tell account holders by email or on the Service before the change takes effect, and we will ask you to accept the updated terms the next time you sign in. If you do not accept them, you can cancel and stop using the Service, and any period you have already paid for runs to its end on the terms you accepted before. A change to section 14 does not apply to a dispute that either of us had already told the other about before the change took effect.

14. Disputes: arbitration and class-action waiver

Talk to us first. Before starting a claim, email [email protected] with your name, your account email, a description of the dispute and what you are asking for. We will do the same with you. Both of us will try in good faith to resolve it for 60 days before starting an arbitration or court case.

Arbitration. If we cannot resolve it, you and SimuSign agree that any dispute, claim or controversy arising out of or relating to the Service or these terms — including whether this section applies — will be resolved by binding individual arbitration, not in court. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, before a single arbitrator. The hearing will take place by video or phone, or in person in the county where you live, as you prefer. The arbitrator may award the same individual relief a court could, and only to you. The Federal Arbitration Act governs this section.

Fees. Fees are paid as the AAA's Consumer Arbitration Rules provide. If you show that the costs of arbitration would be prohibitive compared with going to court, we will pay as much of your filing and arbitrator fees as the arbitrator finds necessary to make arbitration affordable for you.

What is not arbitrated. Either of us may bring an individual claim in small-claims court if it qualifies there. Either of us may ask a court to stop the infringement or misuse of intellectual property, or the misuse of the Service described in section 5.

No class actions. You and SimuSign each bring claims only on an individual basis — not as a plaintiff or class member in any class, collective, consolidated or representative proceeding — and the arbitrator may not combine the claims of more than one person. If this paragraph is found unenforceable for a particular claim, that claim is decided by a court and not by arbitration.

Many similar claims. If 25 or more demands for arbitration that raise similar claims are filed against SimuSign by or with the help of the same or coordinated counsel, they will be administered under the AAA's rules for mass or multiple filings then in effect, and may be heard in batches.

You can opt out. You can decline this arbitration agreement by emailing [email protected], with the subject line "Arbitration opt-out", within 30 days after you first accept these terms (or, if you had an account before October 15, 2026, within 30 days after you accept this version). Include your name and your account email, and say that you opt out of arbitration. Opting out does not affect any other part of these terms.

Where this section does not apply. If you live in a province, state or country whose law does not allow a consumer to agree in advance to arbitration or to give up class proceedings — for example Quebec or Ontario — this section does not apply to you, and disputes go to the courts that law allows.

Earlier disputes. This section applies to disputes that arise, or that either of us first raises, after you accept this version of these terms.

15. Governing law and courts

These terms are governed by the laws of the State of Illinois, United States, and, for section 14, the Federal Arbitration Act, without regard to conflict-of-laws rules. Any dispute that is not arbitrated will be brought only in the state or federal courts located in Illinois, and you and we consent to their jurisdiction. Nothing in these terms limits rights you have under the consumer-protection laws where you live.

16. General

These terms, the Privacy Policy and the limits page are the whole agreement between you and us about the Service. If a part of these terms cannot be enforced, the rest still applies. If we do not enforce a right, we have not given it up. You may not transfer these terms; we may transfer them to a successor to SimuSign's business. We are not responsible for a delay or failure caused by events beyond our reasonable control, such as outages of the networks or providers we rely on, natural disasters or government action. Sections 8 to 11, 14, 15 and this section continue to apply after these terms end.
